Terms of Service

These Terms of Service ("Terms") govern your access to and use of TellMeForever, including our website, applications, telephone recording services, transcription services, recording storage, interview features, scheduled message features, printed products, and related services (collectively, the "Service").

TellMeForever is operated by StackBridge IT LLC, doing business as TellMeForever ("TellMeForever," "we," "us," or "our").

By creating an account, purchasing recording time, submitting or accepting a recording, inviting another person to participate, scheduling a message, ordering a printed product, or otherwise using the Service, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the Service.


1. What TellMeForever Does

TellMeForever helps people preserve stories, memories, interviews, and personal messages.

Depending on the features available to you, the Service may allow you to:

  • Create interviews containing questions for yourself or another person.
  • Select questions from suggested question libraries.
  • Record answers directly from a supported device.
  • Invite another person to record answers using a private link.
  • Record or receive answers by telephone.
  • Transcribe recorded audio.
  • Review, edit, organize, accept, and finalize recordings.
  • Create downloadable transcripts.
  • Create QR codes or links that provide access to finalized recordings.
  • Combine selected interview responses into a book.
  • Order printed copies of books.
  • Create a scheduled recording or "Message in a Bottle" for delivery to another person at a future date.
  • Purchase additional recording time.

Features may be added, removed, or changed as the Service develops.


2. Eligibility

You must be at least 18 years old to create a TellMeForever account or make a purchase.

You may not create an account on behalf of someone who is unable to legally agree to these Terms unless you have lawful authority to act for that person.

Children

TellMeForever is not intended for children under 13.

You may not use the Service to knowingly collect or submit recordings, personal information, or other content from a child under 13.

If a person being interviewed or recorded is between 13 and 17 years old, you must have permission from their parent or legal guardian before using TellMeForever to record them.

You are responsible for complying with any additional laws that apply to recording or collecting information from minors.


3. Your Account

You are responsible for maintaining accurate account information.

You must:

  • Provide an email address you have access to.
  • Keep your password and login credentials secure.
  • Notify us if you believe your account has been compromised.
  • Keep your contact information reasonably current.

You are responsible for activity performed through your account unless the activity resulted from a security failure caused by us.

You may not sell, rent, transfer, or share access to your account for commercial purposes.


4. Interviews and Invitations

TellMeForever allows you to invite other people to participate in interviews.

You must have the person's permission before recording them.

By sending an interview invitation, initiating a telephone recording, or otherwise asking someone to participate through TellMeForever, you represent that:

1. you have permission to contact that person for this purpose; 2. you will not attempt to record them secretly; 3. you will comply with all laws applicable to the recording; and 4. you will respect the person's decision not to participate.

An invited person is never required to answer a question.

Participants may:

  • Skip individual questions.
  • Stop recording at any time.
  • Decline an invitation.
  • Stop participating entirely.
  • Request that we stop sending them invitations or other participant-related communications.

If a participant tells us they do not want to receive further communications through TellMeForever, we may place their email address, telephone number, or other contact information on a suppression list so that additional messages are not sent to them.

That restriction may apply even if an account holder later attempts to contact them through the Service.


5. Recording Consent and Recording Laws

Recording laws vary by country, state, and jurisdiction.

Some jurisdictions allow a conversation to be recorded with the consent of one participant. Other jurisdictions may require the consent of every participant.

You are responsible for determining whether a recording is lawful before making it.

Do not use TellMeForever to secretly record another person.

When TellMeForever provides a telephone recording feature, the Service may play an automated or spoken notice explaining that the call or response will be recorded and giving the participant an opportunity to decline.

Where provided, you may not remove, bypass, interfere with, obscure, or attempt to defeat a recording notice or consent mechanism.

A notice provided by TellMeForever does not relieve you of your responsibility to comply with applicable recording and privacy laws.

If you are unsure whether you may legally record someone, obtain their explicit permission before recording them.


6. Participant Rights

People whose voices or responses are recorded through TellMeForever retain any rights they have under applicable law.

As between TellMeForever and a participant, TellMeForever does not claim ownership of the participant's voice, statements, memories, stories, or other original content.

A participant may contact us if they believe:

  • they were recorded without permission;
  • their recording is being used unlawfully;
  • they are receiving unwanted TellMeForever invitations; or
  • content containing their voice or personal information should be removed.

We may investigate requests and may remove, restrict, or disable access to content when reasonably necessary to comply with law, protect a participant, enforce these Terms, or address a credible rights complaint.


7. Recording Time

TellMeForever may provide free recording time and may allow you to purchase additional recording time.

The amount of free recording time, if any, will be shown in your account or at the time it is offered.

Held Recording Time

Recording time may initially be held when a recording or answer is saved.

Held time is not permanently consumed until the applicable recording or answer is accepted or finalized.

If you delete an unaccepted recording, the associated held time may be returned to your available balance.

This allows you to re-record an answer before accepting it without permanently using recording time for every attempt.

Spent Recording Time

Once you accept or finalize a recording or answer, the associated recording time becomes spent.

Spent recording time is considered used because processing, transcription, storage preparation, and other portions of the Service have been provided.

Deleting an accepted or finalized recording later does not restore spent recording time.

Purchased Recording Time

Unless otherwise stated at the time of purchase:

  • Purchased recording time does not expire.
  • Purchased recording time does not automatically renew.
  • Purchasing recording time does not enroll you in a subscription.
  • Unused purchased recording time has no cash value except where our refund policy or applicable law provides otherwise.

Promotional, complimentary, or bonus recording time may be subject to different conditions disclosed when it is issued.


8. Pricing and Payments

Current prices are displayed before you complete a purchase.

Prices may change in the future, but a price change will not retroactively change a completed purchase.

You authorize our payment processor to charge the payment method you provide for purchases you approve.

Payments may be processed by third-party payment providers such as Stripe or another payment processor.

Applicable sales tax, use tax, VAT, or similar taxes may be added when required.

TellMeForever does not automatically charge you for additional recording time unless an automatic payment feature is separately offered and you expressly agree to it.


9. Refunds

We want you to receive what you paid for.

Unspent Recording Time

Purchased recording time that has not been spent may be eligible for a refund if you request the refund within 30 days of purchase.

Recording time that has already been spent by accepting or finalizing recordings is generally non-refundable because the associated service has already been provided.

Service Failures

If we lose or corrupt a recording due to a failure of our Service, or if another paid digital service is materially defective because of an error on our part, contact us.

Depending on the circumstances, we may:

  • Restore the content.
  • Re-perform the service.
  • Restore recording time.
  • Replace the affected product.
  • Issue a partial or full refund.

Printed Products

If a printed book or other physical product arrives damaged, contains a manufacturing defect, or materially differs from the approved version because of a printing error, contact us promptly.

We may request photographs or other information reasonably necessary to document the problem.

We may replace the affected item or issue a refund where appropriate.

Minor variations in color, paper, trimming, binding, positioning, or other characteristics inherent to commercial printing are not necessarily defects.

Nothing in this section limits refund, warranty, or cancellation rights that cannot legally be waived.


10. Books and Printed Products

TellMeForever may allow you to turn selected interview responses into a printed book or other physical product.

Before placing an order, you may be provided with a preview or proof.

You are responsible for reviewing the proof before ordering.

Check:

  • Names.
  • Dates.
  • Spelling.
  • Transcripts.
  • Photographs.
  • Page order.
  • Formatting.
  • Questions and answers.
  • Any other information important to you.

After you approve a book for printing, errors that appeared in the approved proof are generally not considered printing defects.

Books may be manufactured and shipped by third-party printing and fulfillment companies.

Estimated manufacturing or delivery dates are estimates and are not guaranteed.

Unless specifically offered as part of a purchase, the printable production file used to manufacture a book is not included with the purchase.

A watermarked or lower-resolution digital proof does not grant a right to obtain the underlying print-production file.


11. Transcriptions

TellMeForever may automatically generate transcripts from audio recordings.

Automated transcription is not perfect.

Transcripts may contain:

  • Incorrect words.
  • Incorrect names.
  • Missing words.
  • Punctuation errors.
  • Speaker identification errors.
  • Errors caused by accents, background noise, audio quality, or unusual terminology.

You are responsible for reviewing a transcript before finalizing it or using it in a printed product.

You should not rely on TellMeForever transcription for legal, medical, financial, emergency, or other situations where exact transcription is required.

We may use third-party technology providers to perform transcription or related processing as described in our Privacy Policy.


12. Scheduled Messages and "Message in a Bottle"

TellMeForever may allow you to create a recording for delivery to another person at a future date.

You are responsible for providing accurate recipient contact information.

By scheduling a message, you represent that you have a legitimate reason to contact the recipient and that use of the recipient's contact information for the scheduled delivery is lawful.

The recipient may receive an email or other notification explaining that a TellMeForever message is waiting for them.

Recipient Opt-Out

Recipients may opt out of TellMeForever communications.

If a recipient opts out before a scheduled message is delivered, we may cancel or suppress delivery of that message.

An account holder cannot override a recipient's opt-out request.

Future Delivery

We will make commercially reasonable efforts to deliver a scheduled message at or around the selected date and time.

However, scheduled delivery is not guaranteed.

A message may be delayed or may not be delivered because of circumstances including:

  • An invalid or expired email address or telephone number.
  • Spam or security filtering.
  • Recipient account restrictions.
  • Recipient opt-out requests.
  • Service outages.
  • Changes to communications providers.
  • Changes in law.
  • Account deletion.
  • Account suspension.
  • Content removal.
  • Events outside our reasonable control.

TellMeForever should not be used to deliver emergency information, legal notices, time-sensitive financial instructions, medical information, or any message where failure to deliver at an exact time could result in harm.


13. Your Content and Ownership

"User Content" includes recordings, audio, transcripts, written questions, photographs, messages, book content, names, and other material submitted to TellMeForever.

Your Rights

TellMeForever does not claim ownership of your User Content.

As between you and TellMeForever, you and the people who contribute content retain whatever ownership and other rights each of you has under applicable law.

Paying for an interview does not automatically transfer another person's copyright, privacy, publicity, or other legal rights to you.

Permission You Give Us

You grant TellMeForever a non-exclusive, worldwide, royalty-free license to host, store, copy, process, transcribe, format, reproduce, transmit, and otherwise use User Content only as reasonably necessary to operate and provide the Service.

For example, this permission allows us to:

  • Store recordings.
  • Generate transcripts.
  • Display recordings to authorized users.
  • Produce PDFs.
  • Generate QR codes or access links.
  • Format books.
  • Send content to a printing provider when you order a book.
  • Deliver scheduled messages.
  • Back up and secure the Service.
  • Investigate technical problems.
  • Comply with legal obligations.

This license ends when the relevant content is permanently deleted from our systems, except to the extent limited copies remain temporarily in routine backups or must be retained for legal, security, fraud-prevention, or compliance purposes.

No AI Training With Your Recordings

We do not use your private recordings, interviews, transcripts, or scheduled personal messages to train our own general-purpose artificial intelligence models.

We do not sell your private recordings or transcripts.

Our use of service providers and subprocessors needed to operate features such as hosting, transcription, email delivery, payment processing, telephone services, and printing is described in our Privacy Policy.

Marketing

We will not use a private recording or personal interview as advertising or a public testimonial without additional permission.


14. Your Responsibility for Content

You represent that you have the rights and permissions necessary to submit User Content to the Service and to instruct us to process it.

Do not upload or create content that:

  • Infringes another person's copyright or other intellectual property rights.
  • Violates another person's privacy or publicity rights.
  • Was obtained through unlawful recording.
  • Contains unlawful threats or harassment.
  • Exploits or endangers a child.
  • Contains illegal sexual content.
  • Facilitates fraud or impersonation.
  • Contains malware or malicious code.
  • Is otherwise unlawful.

We may remove or restrict access to content that we reasonably believe violates these Terms or applicable law.


15. Copyright and Intellectual Property Complaints

If you believe content available through TellMeForever infringes your copyright or other intellectual property rights, contact us using the support information provided on our Help or Contact page.

Please provide enough information for us to identify:

  • The copyrighted or protected work.
  • The content you believe is infringing.
  • Where the content appears.
  • Your contact information.
  • The basis for your claim.

We may remove or disable access to allegedly infringing content while reviewing a complaint.

Users who repeatedly infringe the intellectual property rights of others may have their accounts suspended or terminated.


16. TellMeForever's Intellectual Property

The TellMeForever Service itself is owned by us or our licensors.

This includes our:

  • Software.
  • Website design.
  • Applications.
  • Logos.
  • Trademarks.
  • Service name.
  • Original graphics.
  • Interface.
  • Proprietary templates and technology.

These Terms do not transfer ownership of TellMeForever's intellectual property to you.

You may use the Service only for its intended purpose.


17. Prohibited Uses

You may not:

  • Record someone without the consent required by applicable law.
  • Attempt to bypass a recording notice or consent mechanism.
  • Use false contact information to impersonate another person.
  • Harass someone through repeated invitations or scheduled messages.
  • Contact someone through TellMeForever after they have opted out.
  • Access or attempt to access another person's account.
  • Access recordings, books, messages, or files you are not authorized to access.
  • Probe or circumvent security controls.
  • Introduce malware or harmful code.
  • Attack, overload, disrupt, scrape, or interfere with the Service.
  • Reverse engineer the Service except where applicable law expressly permits it.
  • Use automated systems to abuse the Service.
  • Resell account access or recording time without our written permission.
  • Use the Service for illegal activity.

We may suspend or terminate accounts engaged in prohibited activity.


18. Privacy

Our collection and use of personal information is described in our Privacy Policy.

Because TellMeForever involves personal stories and voice recordings, some User Content may be particularly personal.

We use service providers as necessary to operate the Service, which may include providers for:

  • Cloud hosting and storage.
  • Audio processing.
  • Transcription.
  • Email delivery.
  • Telephone services.
  • Payment processing.
  • Customer support.
  • Security and fraud prevention.
  • Printing and fulfillment.

Our Privacy Policy provides additional information about these practices.


19. Security

We use reasonable administrative, technical, and organizational measures designed to protect the Service and User Content.

No internet-connected system or storage provider can guarantee absolute security.

You should maintain your own copies of recordings, transcripts, photographs, books, or other material that would be irreplaceable to you.


20. Long-Term Storage and QR Codes

TellMeForever is designed to preserve finalized recordings for long-term access.

However, we do not promise that any digital content will remain available literally forever.

Technology, businesses, storage systems, laws, domain names, file formats, and communications systems can change over time.

You should maintain independent copies of anything that is important or irreplaceable.

A QR code or access link may depend on TellMeForever's systems remaining available. The QR code itself does not contain the entire recording unless expressly stated otherwise.

We may migrate recordings between storage systems, formats, domains, or infrastructure as necessary to maintain or improve the Service.


21. Third-Party Services

Parts of TellMeForever may depend on third-party services.

These may include payment processors, telephone providers, cloud platforms, email providers, transcription providers, printing companies, shipping companies, or other technology vendors.

We are not responsible for a third party's independent services, websites, or conduct.

However, this does not limit our responsibilities to you for portions of the TellMeForever Service that we are legally responsible for providing.


22. Service Availability

We work to keep TellMeForever available and reliable, but we do not guarantee uninterrupted operation.

The Service may occasionally be unavailable because of:

  • Maintenance.
  • Software updates.
  • Equipment failure.
  • Network problems.
  • Cybersecurity incidents.
  • Third-party outages.
  • Natural disasters.
  • Government actions.
  • Other circumstances outside our reasonable control.

We may modify, replace, discontinue, or introduce features over time.

If we permanently discontinue a material paid feature, we will make reasonable efforts to provide affected users with notice and an opportunity to retrieve relevant content where practical.


23. Account Suspension

We may temporarily suspend an account when reasonably necessary to:

  • Protect the Service or other users.
  • Investigate suspected unauthorized access.
  • Investigate fraud.
  • Address a legal request.
  • Investigate a violation of these Terms.
  • Prevent unlawful or harmful activity.

Where appropriate, we will attempt to notify you of the suspension.

Access to content during a suspension may be restricted while an investigation is pending.


24. Account Termination

You may close your account through the available account settings or by contacting us.

We may terminate an account for a material or repeated violation of these Terms.

Except where prohibited by law, required for security, or necessary to prevent harm, we will make reasonable efforts to allow you to retrieve your lawful User Content before permanently terminating your access.

We are not required to preserve or provide content that is unlawful, subject to a valid legal preservation requirement, malicious, or reasonably believed to violate another person's rights.


25. Account Deletion and Content Deletion

Deleting your account may permanently delete your recordings, transcripts, books, scheduled messages, and other User Content.

Download anything you want to keep before deleting your account.

Deletion from active systems may not immediately remove every copy from disaster-recovery systems, routine backups, security logs, or systems where temporary retention is necessary for legal or technical reasons.

Residual copies will be handled according to our retention practices and Privacy Policy.

Scheduled messages that have not yet been delivered may be canceled when the originating account or associated content is deleted.


26. Disclaimer of Warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available."

We do not guarantee that:

  • The Service will always be available.
  • Every recording will be error-free.
  • Automated transcripts will be completely accurate.
  • A recipient will receive a scheduled message.
  • An email will avoid spam filtering.
  • A QR code or link will remain accessible indefinitely.
  • Every third-party provider will remain available.
  • The Service will meet every user's particular requirements.

Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded.


27. Limitation of Liability

To the fullest extent permitted by law, TellMeForever and StackBridge IT LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the Service.

This includes, where permitted by law, damages arising from:

  • Loss of data.
  • Lost recordings.
  • Loss of profits.
  • Loss of business.
  • Emotional or sentimental value.
  • Failure of a scheduled message to arrive.
  • Unauthorized access caused by circumstances outside our reasonable control.
  • Reliance on an automated transcript.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the total amount you paid TellMeForever during the 12 months immediately preceding the event giving rise to the claim.

These limitations do not apply where liability cannot legally be limited or excluded.

Some jurisdictions do not permit certain warranty disclaimers or limitations of liability, so portions of this section may not apply to you.


28. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless TellMeForever, StackBridge IT LLC, and their officers, employees, contractors, and affiliates from claims, losses, liabilities, damages, and reasonable expenses arising from:

  • Your unlawful use of the Service.
  • Your violation of these Terms.
  • Content you submit without the necessary rights or permissions.
  • Your unlawful recording of another person.
  • Your violation of another person's privacy, copyright, publicity, or other rights.

This obligation does not apply to the extent a claim results from our own negligence, misconduct, or violation of law.


29. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles.

Subject to any consumer rights that legally permit you to bring a claim elsewhere, disputes relating to these Terms or the Service will be brought in a state or federal court with jurisdiction in or serving Jefferson County, Kentucky.

Nothing in these Terms prevents either party from bringing an eligible claim in small claims court.

Nothing in this section takes away rights that applicable consumer law does not permit you to waive.


30. Resolving Problems

Before filing a lawsuit relating to the Service, you and TellMeForever agree to make a reasonable effort to resolve the issue informally.

Send us a description of:

  • What happened.
  • What resolution you are requesting.
  • The email address associated with your account.
  • Any relevant order, transaction, interview, or recording information.

We will make a reasonable effort to review and respond.

This informal process does not prevent either party from seeking immediate relief where necessary to prevent imminent harm or preserve legal rights.


31. Changes to These Terms

TellMeForever maintains versioned Terms of Service.

When these Terms change:

  • The new version will have an updated effective date.
  • Previous versions may be retained.
  • We may maintain a record of the version accepted when you created your account or otherwise agreed to the Terms.
  • Changes will apply prospectively rather than rewriting the terms that governed a transaction after it occurred.

For material changes, we may provide notice through the Service or by email.

Where required by law, we will request affirmative agreement to updated Terms.

Continued use of the Service after updated Terms become effective may constitute acceptance of the updated Terms where permitted by law.


32. Electronic Communications

By creating an account, you agree that we may send you electronic communications relating to the operation of the Service.

These may include:

  • Account verification.
  • Security notices.
  • Purchase receipts.
  • Recording notifications.
  • Interview invitations you initiated.
  • Scheduled-message information.
  • Service notices.
  • Changes to these Terms or our Privacy Policy.
  • Customer-support communications.

Marketing communications, where offered, will be handled separately and may include an unsubscribe option.

Transactional or legally required account communications may still be sent even if you unsubscribe from marketing.

Recipients who are not TellMeForever account holders may opt out of future participant invitations or scheduled-message notifications as described elsewhere in these Terms.


33. Assignment

You may not transfer your rights under these Terms to another person without our consent.

We may assign these Terms in connection with a merger, acquisition, corporate reorganization, financing, sale of assets, or transfer of the TellMeForever business, provided that the successor remains responsible for obligations applicable to the Service.


34. No Waiver

If we do not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce it later.


35. Severability

If a court determines that part of these Terms is invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.


36. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms expressly presented for a particular paid product or feature, constitute the agreement between you and TellMeForever concerning the Service.

If specific terms presented at the time of a purchase conflict with these general Terms, the specific purchase terms control for that purchase.


37. Events Outside Our Control

We are not responsible for delays or failures caused by events outside our reasonable control, including natural disasters, widespread internet or telecommunications failures, government actions, labor disruptions, war, terrorism, civil unrest, utility failures, or failures of critical third-party infrastructure.

This section does not limit rights that cannot legally be waived.
